Terms of Service

Please read these terms carefully before using Quick Charge's portable charging services.

Welcome to Quick Charge! These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Quick Charge, LLC ("Quick Charge," "we," "us," or "our") governing your use of our portable smartphone charger rental services.

By renting a portable charger from any Quick Charge kiosk, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Quick Charge services through any of our kiosks, you confirm that:

  • You are at least 18 years of age or have parental/guardian consent
  • You have the legal capacity to enter into binding agreements
  • You agree to comply with all applicable laws and regulations
  • You accept full responsibility for proper use and return of the rental equipment

2. Service Description

Quick Charge provides on-demand rental of portable smartphone chargers through automated kiosks located in various public venues including shopping malls, entertainment centers, and other high-traffic locations.

Service Features:

  • Portable battery packs compatible with multiple smartphone types
  • Built-in charging cables for various device types
  • Hourly rental rates with automatic billing
  • 500+ kiosk locations nationwide

Important: We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Rental Process and Requirements

3.1 Initiating a Rental

To rent a portable charger:

  1. Locate a Quick Charge kiosk
  2. Follow the on-screen instructions at the kiosk
  3. Provide valid payment information (credit/debit card or mobile payment)
  4. Retrieve the portable charger from the kiosk slot

3.2 Rental Period

The rental period begins when you retrieve the charger from the kiosk and ends when you successfully return it to the same kiosk location. Rental fees are calculated on an hourly basis and automatically charged to your payment method.

3.3 Return Requirements

Critical Return Policy

Portable chargers MUST be returned to the same kiosk location where they were rented. Returns to different kiosk locations are not accepted and may result in additional charges or penalties.

4. Fees, Payments, and Charges

4.1 Rental Fees

Rental fees are displayed at each kiosk and are subject to change without notice. Standard charges include:

  • Hourly rental rate (displayed at kiosk)
  • Daily maximum rate cap (if applicable)
  • Grace period for returns (typically 15 minutes, no charge)

4.2 Late Fees

Continued charges will accrue for each hour (or portion thereof) that the charger remains in your possession beyond the initial rental period. There is no maximum rental period, but extended rentals will result in significantly higher charges.

4.3 Lost or Damaged Equipment

Lost Equipment

You will be charged a replacement fee (typically $50-$100) if the charger is not returned within 30 days.

Damaged Equipment

You are responsible for repair or replacement costs if the charger is returned in damaged condition due to misuse or negligence.

4.4 Payment Authorization

By providing payment information, you authorize Quick Charge to charge your payment method for all applicable fees, including rental charges, late fees, replacement fees, and any other charges incurred during your rental period. You are responsible for ensuring your payment method remains valid and has sufficient funds.

5. User Responsibilities

As a Quick Charge customer, you agree to:

Handle with Care

Use the charger responsibly and avoid exposure to water, extreme temperatures, or physical damage

No Tampering

Do not disassemble, modify, or attempt to repair the charger

Timely Return

Return the charger to the same kiosk location as soon as you're finished

Personal Use Only

Do not resell, rent, or transfer the charger to others

6. Prohibited Activities

You may not use Quick Charge services to engage in any of the following prohibited activities:

Attempting to hack, tamper with, or bypass kiosk security measures
Using stolen payment methods or fraudulent payment information
Removing, defacing, or altering any Quick Charge branding or identification labels
Renting chargers for commercial resale or unauthorized distribution
Damaging, vandalizing, or interfering with kiosk operations
Using the service in violation of applicable laws or regulations

7. Limitation of Liability

Important Legal Notice

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICK CHARGE SHALL NOT BE LIABLE FOR:

  • Any damage to your smartphone or other electronic devices caused by use of our chargers
  • Data loss, corruption, or security breaches on your personal devices
  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions, kiosk malfunctions, or unavailability

Our total liability to you for any claims arising from your use of Quick Charge services shall not exceed the amount you paid for the specific rental transaction that gave rise to the claim, or $50, whichever is less.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

8. Warranty Disclaimer

QUICK CHARGE SERVICES AND EQUIPMENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement or title
  • Warranties regarding availability, reliability, or compatibility
  • Warranties that our chargers will be error-free or uninterrupted

We make reasonable efforts to maintain our equipment in good working condition, but we do not guarantee that chargers will be fully charged, compatible with all devices, or free from defects.

9. Indemnification

You agree to indemnify, defend, and hold harmless Quick Charge, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Your use or misuse of Quick Charge services or equipment

Your violation of these Terms of Service

Your violation of any applicable laws or regulations

Your infringement of any third-party rights

10. Dispute Resolution and Arbitration

10.1 Informal Resolution

Before pursuing formal legal action, you agree to attempt to resolve any disputes with Quick Charge by contacting our customer support team. Most disputes can be resolved quickly and amicably through direct communication.

10.2 Binding Arbitration

If informal resolution fails, you agree that any disputes arising from these Terms or your use of Quick Charge services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration will be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association. The arbitrator's decision will be final and binding.

10.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive the right to participate in class action lawsuits against Quick Charge.

11. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding related to these Terms (other than arbitration) shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

12. Modifications to Terms

Quick Charge reserves the right to modify these Terms of Service at any time. When we make changes, we will:

Update the "Effective Date" at the top of these Terms
Display notice of material changes at our kiosks
Post updated Terms on our website

Your continued use of Quick Charge services after the effective date of any changes constitutes your acceptance of the modified Terms.

13. Termination and Suspension

Quick Charge reserves the right to suspend or terminate your access to our services at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms

Fraudulent activity

Failure to return equipment

Payment issues or disputes

Upon termination, you must immediately return all rented equipment and pay all outstanding charges. Termination does not relieve you of any obligations incurred prior to termination.

14. Privacy and Data Protection

Your use of Quick Charge services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By accepting these Terms, you also agree to our Privacy Policy.

15. Intellectual Property Rights

All content, trademarks, logos, and intellectual property associated with Quick Charge services, including our kiosks, branding, software, and website, are owned by or licensed to Quick Charge and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works from any Quick Charge materials without our express written permission.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Quick Charge regarding your use of our services and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.
